"If a child is too small to advance into the restraint for their age, they should remain in the restraint specified for the previous age group until they have outgrown that restraint."

I am presenting this submission for Part 16, Section 266, (2B) in this section the law currently states that;

" If the passenger is 4 years old or older, but is less than 7 years old, he or she must—

(a) be restrained in a suitable and properly fastened and adjusted forward facing

approved child restraint that has an inbuilt harness; or

(b) be placed on a properly positioned approved booster seat and be restrained by

either a suitable lap and sash type approved seatbelt that is properly adjusted

and fastened, or by a suitable approved child safety harness that is properly

adjusted and fastened; or

(c) if he or she is seated in a seating position in a part of the vehicle that is

designed primarily for the carriage of goods—

(i) be restrained by a suitable lap and sash type seatbelt that is properly

adjusted and fastened; or

(ii) have the midsection of his or her body restrained by a suitable lap

type seatbelt that is properly adjusted and fastened, and have his or

her upper body restrained by an approved child safety harness that is

properly adjusted and fastened."

I would wish and urgently call for an amendment to part (a) to instead state: "be restrained in a suitable and properly fastened and adjusted REAR FACING or forward facing

approved child restraint that has an inbuilt harness;"

Hereby adding the ability to restrain a child between the ages of 4 and 7 in a suitable restraint, such as the now approved "A4" standard seats (Namely, Infasecure Quattro, Kompressor 4, Grandeur, Babylove Ezy Switch EP 2013, etc). These seats are all AS/NZS 1754:2013 approved and no-longer bound by weight limits, purely "height markers".

I hope you will consider my submission, as I feel this is a very concerning hole currently needing to be amended in our road rules at a National level.
